1. Introduction
These Terms of Service ("Terms") govern your use of the GlobMedTrust website and services. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
2. Our Services
GlobMedTrust operates as a medical tourism consultancy. We facilitate connections between clients and accredited clinics, surgeons, and healthcare providers in Turkey. We coordinate logistics including travel, accommodation, and aftercare support. We do not provide medical advice, diagnoses, or treatment directly.
3. Role as Intermediary
GlobMedTrust acts as an intermediary between you and independent medical professionals and facilities. While we carefully vet all partner clinics and surgeons, we are not a healthcare provider. The medical relationship is between you and the treating physician. All medical decisions, including whether to proceed with treatment, rest with you and your chosen surgeon.
4. Eligibility
You must be at least 18 years of age to use our services. By engaging with GlobMedTrust, you confirm that the information you provide is accurate and complete. You are responsible for disclosing all relevant medical history to both GlobMedTrust and your treating physician.
5. Consent & Data Protection
By using our services, you acknowledge that you have read and understood our Privacy Policy. We process your personal data in accordance with the EU General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA/CPRA), and other applicable privacy laws. You have the right to withdraw consent for data processing at any time. For medical data, we obtain your explicit consent before sharing any information with partner clinics.
6. Consultation Fee & Payment
A consultation fee of $49.00 USD is required to book a 60-minute expert consultation. This fee is processed through PayPal, Inc. and is subject to PayPal's User Agreement. By completing a payment, you also agree to PayPal's terms.
- The consultation fee is separate from any treatment costs quoted by partner clinics
- GlobMedTrust does not store your payment card information — all financial data is processed directly by PayPal
- Payment confirmation is required before accessing the appointment scheduling system
- Refund requests for the consultation fee are handled on a case-by-case basis; contact us at Globmedtrust@gmail.com
EU/EEA Consumers — Right of Withdrawal
Under the EU Consumer Rights Directive (2011/83/EU), you have a 14-day right of withdrawal from the date of purchase. However, by requesting that the consultation service begins before the 14-day period expires (i.e., by booking and attending an appointment), you expressly acknowledge and consent that: (a) the service will be performed before the withdrawal period has expired, and (b) you will lose your right of withdrawal once the consultation has been fully performed. If you exercise your right of withdrawal before the consultation takes place, you will receive a full refund of the consultation fee.
7. Appointment Scheduling (Calendly)
After payment, you may schedule your consultation using the embedded Calendly widget. Calendly, LLC provides the scheduling service and operates under its own Terms of Use. By booking an appointment, you also agree to Calendly's terms.
- Appointment availability is subject to our team's schedule and may vary
- You will receive a confirmation email from Calendly with the meeting details and video call link
- Rescheduling and cancellation are available through the link in your Calendly confirmation email
- If you fail to attend your scheduled appointment without prior notice, the consultation fee is forfeited
- GlobMedTrust is not responsible for technical issues with the Calendly platform; if scheduling is unavailable, contact us directly
8. Consultation & Treatment Process
- Paid consultations include a 60-minute session with our specialist team
- Treatment plans and quotes are prepared by the partner clinic based on your needs
- Proceeding with treatment requires your informed consent and agreement to the clinic's terms
- We coordinate logistics but do not guarantee specific medical outcomes
9. Pricing & Payment for Treatments
All treatment prices are provided by the partner clinics and may vary based on individual assessments. Prices quoted during consultation are estimates and may be adjusted following in-person examination. Payment terms, methods, and refund policies for medical procedures are determined by the individual clinic. GlobMedTrust does not handle payments for medical procedures directly.
10. Travel, Accommodation & Insurance
When included in your package, travel and accommodation arrangements are coordinated by GlobMedTrust through third-party providers. We are not liable for cancellations, delays, or issues caused by airlines, hotels, or transfer services.
Insurance Requirement
GlobMedTrust strongly recommends — and in some cases may require — that all patients obtain comprehensive travel and medical insurance before travelling for treatment. Your insurance should cover, at minimum: medical complications arising from elective procedures, emergency medical evacuation and repatriation, trip cancellation or interruption, and personal liability abroad. Proceeding without adequate insurance is entirely at your own risk, and GlobMedTrust accepts no liability for costs arising from uninsured medical events, extended hospital stays, or emergency repatriation.
11. Medical Risks & Informed Consent
All medical and surgical procedures carry inherent risks. By engaging our services, you acknowledge that you understand these risks and have discussed them with your treating physician. GlobMedTrust is not liable for complications, adverse outcomes, or dissatisfaction with medical results. We strongly encourage you to obtain independent medical advice before proceeding. Your treating clinic will provide a separate informed consent form detailing procedure-specific risks.
11A. Cross-Border Medical Jurisdiction
Medical procedures facilitated by GlobMedTrust are performed in the Republic of Turkey by independently licensed Turkish medical professionals. Any medical malpractice claims, clinical negligence disputes, or complaints regarding the standard of care are governed by the laws of the Republic of Turkey and fall within the jurisdiction of Turkish courts. GlobMedTrust, as an intermediary, is not a party to the doctor-patient relationship and cannot be held liable for clinical decisions, surgical outcomes, or standards of care provided by third-party medical professionals. We recommend consulting a legal professional in your home country if you have questions about cross-border medical liability.
11B. Aftercare & Post-Return Responsibility
GlobMedTrust coordinates aftercare support during your stay in Turkey as part of our service packages. However, the scope of our aftercare responsibility is limited as follows:
- In-Turkey aftercare (post-operative check-ups, medication, and dressing changes) is provided by the treating clinic during your stay
- Once you depart Turkey, ongoing medical follow-up and post-operative care become your responsibility
- GlobMedTrust will assist in facilitating remote communication with your surgeon for up to 12 months post-procedure for questions and guidance, but this does not constitute medical treatment
- Any complications arising after your return home should be addressed by a qualified local physician; in emergencies, contact your local emergency services immediately
- GlobMedTrust is not liable for complications, adverse outcomes, or additional costs arising after your departure from Turkey, including but not limited to revision surgeries, extended recovery, or additional medical treatment in your home country
We strongly recommend establishing a relationship with a local physician before your trip so you have continuity of care upon your return.
12. Third-Party Services & Platforms
Our services rely on third-party platforms for payment processing and appointment scheduling. By using these features on our website, you acknowledge and agree to the following:
12.1 PayPal
- Consultation fee payments are processed by PayPal, Inc. and are subject to PayPal's User Agreement and Privacy Statement
- GlobMedTrust is not responsible for PayPal service outages, payment processing errors, or disputes handled through PayPal's resolution centre
- PayPal's buyer protection policies may apply to your transaction independently of our terms
- Currency conversion fees, if applicable, are determined by PayPal and are the responsibility of the user
12.2 Calendly
- Appointment scheduling is powered by Calendly, LLC and is subject to Calendly's Terms of Use and Privacy Notice
- GlobMedTrust is not responsible for technical issues, downtime, or errors in the Calendly platform
- Booking confirmations and calendar invitations are sent by Calendly; ensure your email settings allow messages from calendly.com
- By using the Calendly widget, you consent to Calendly's data collection practices as described in their privacy notice
12.3 WhatsApp
- WhatsApp communication is operated by Meta Platforms, Inc. and subject to WhatsApp's Terms of Service
- Messages sent via WhatsApp are end-to-end encrypted by WhatsApp; GlobMedTrust does not control or access encryption keys
- We are not responsible for message delivery failures or WhatsApp service interruptions
13. Limitation of Liability
To the fullest extent permitted by law, GlobMedTrust shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to medical complications, travel disruptions, or loss of income. Our total liability shall not exceed the fees paid to GlobMedTrust for consultancy services. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable EU or US consumer protection law.
14. Consumer Protection Rights
Nothing in these Terms affects your statutory rights as a consumer. If you are an EU/EEA consumer:
- You have a 14-day right of withdrawal from distance contracts, unless the service has been fully performed with your prior express consent
- Any dispute may be submitted to an EU-certified online dispute resolution (ODR) platform at ec.europa.eu/consumers/odr
- Unfair contract terms are not enforceable under the EU Unfair Contract Terms Directive
If you are a US consumer, you retain all rights under applicable state consumer protection laws, including but not limited to the right to seek redress for deceptive trade practices.
15. Intellectual Property
All content on this website — including text, images, logos, and design — is the property of GlobMedTrust and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.
16. User Conduct
When using our website and services, you agree not to:
- Provide false or misleading information
- Use the website for any unlawful purpose
- Attempt to gain unauthorised access to our systems
- Reproduce or redistribute website content without permission
17. Cancellations & Right of Withdrawal
If you wish to cancel or reschedule your treatment, please contact your coordinator as soon as possible. Cancellation policies vary by clinic and may include fees. Travel and accommodation cancellations are subject to the terms of the respective providers. EU/EEA consumers may exercise their right of withdrawal within 14 days of entering into a distance contract, unless the service has been fully performed with prior express consent and acknowledgement that the right of withdrawal will be lost.
18. Dispute Resolution
We encourage you to contact us directly to resolve any disputes.
EU/EEA Consumers
If a resolution cannot be reached, EU/EEA consumers may submit their dispute to the European Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. You also retain the right to bring proceedings in the courts of your country of residence in accordance with applicable EU regulations (Regulation (EU) No 1215/2012).
US Consumers
For US consumers, any dispute arising out of or relating to these Terms that cannot be resolved informally may be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted on an individual basis — you agree to waive the right to participate in a class action, class arbitration, or representative action. Nothing in this clause limits your right to bring claims in small claims court where eligible.
Arbitration Opt-Out
You may opt out of the arbitration and class action waiver provisions above by sending written notice to Globmedtrust@gmail.com within 30 days of first accepting these Terms. Your notice must include your full name, mailing address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the courts of competent jurisdiction.
19. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. However, if you are a consumer in the EU/EEA, you will benefit from any mandatory provisions of the law of the country in which you reside. If you are a US consumer, applicable state consumer protection laws also apply.
20. Changes to These Terms
We reserve the right to update these Terms at any time. Material changes will be communicated via a prominent notice on our website at least 30 days before taking effect. Continued use of our services after any modification constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using our services.
21. Force Majeure
GlobMedTrust shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics or epidemics, government travel bans or restrictions, war, terrorism, civil unrest, strikes, airline cancellations, changes in visa or immigration regulations, or failure of third-party services. In such events, we will use reasonable efforts to mitigate the impact and communicate with affected clients promptly.
22. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless GlobMedTrust, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of our services, (b) your violation of these Terms, (c) your provision of false or misleading information, or (d) your violation of any third party's rights. This indemnification obligation does not apply to the extent that the claim arises from GlobMedTrust's own negligence or wilful misconduct. This clause does not affect your statutory rights as a consumer under EU or US law.
23. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent, or if modification is not possible, it shall be severed from these Terms.
24. Entire Agreement
These Terms, together with our Privacy Policy, Medical Disclaimer, and Cookie Policy, constitute the entire agreement between you and GlobMedTrust regarding your use of our website and services. They supersede all prior agreements, understandings, and communications, whether written or oral. For the avoidance of doubt, the medical relationship between you and your treating physician is governed by separate agreements with the treating clinic.
25. Accessibility
GlobMedTrust is committed to ensuring that our website is accessible to all users, including those with disabilities. We strive to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, in alignment with the European Accessibility Act (Directive (EU) 2019/882) and the Americans with Disabilities Act (ADA).
